Terms and Conditions
In these terms and conditions "Buyer" and/or references to “you” means the individual/ individuals entering into a contract for the supply of goods from Sunbed & Leisure; and “Seller” and/or references to ‘we’ or ‘us’ or ‘our’ means Sunbed & Leisure, a trading division of Tecnosole Sales UK Ltd, whose offices are at Unit 8, Network Centre, Midland Way, Barlborough, S43 4WW.
1. Payment
"Goods" means all or any of the items listed on the invoice. Goods will only be dispatched to you once payment has been received in full (in cleared funds in our bank account) or you have completed an approved credit agreement with our approved credit company.
2. Special Orders
"Special Orders" means any Goods that are not held in stock by Sunbed & Leisure or that are ordered and/or manufactured specifically for you. Payment in full is required on Special Orders at the time of your order. An approximate delivery time scale will be provided. Whilst every effort will be made to ensure the estimated dates are met they do not form a fixed term of the contract. Once goods are received at our Home Delivery Centre we will contact you to arrange a delivery date. Special Order items are non-returnable and non-refundable unless there is evidence of a substantial manufacturers fault.
3. Website Inaccuracies
Display products in stores are examples of the finished product. Goods are supplied on the understanding that there may be slight variances in colour, finish, shade and grain particularly, but not exclusively, on wood or metal products. Wood materials may have minor technical differences and their appearance may differ slightly from the goods shown. Any changes will be of an equal or higher standard to those displayed.
The information, services and products provided on and throughout this site are subject to change without notice. In the event of a genuine website error or inaccuracy we reserve the right to withdraw an offer immediately. We also reserve the right to cancel all confirmed orders that are subject to genuine website error or inaccuracy. All products offered are subject to availability.
4. Title and Risk
We will retain legal ownership of the Goods until the later of (i) delivery of the Goods, and (ii) our receipt of your payment in full in cleared funds. The goods will be at your risk from the point of delivery (please refer to point 7 below)" this means that you will be responsible for any damage caused to the Goods for whatever reason after this point in time.
5. Cancellation/Refunds
We offer a full money back guarantee for items purchased from our website or via the telephone with our Internet Sales Department, excluding all carriage costs, if returned unused in the original packaging within 7 working days following the day of delivery.
6. Access
We will place the Goods in the room of your choice at the delivery address, provided that the room is clear; and the route from the delivery vehicle to the room is also clear.
It is your responsibility to ensure that the Goods will fit into the intended room and that they will pass through all doorways, stairs, gates, alleyways and any other physical features between the delivery vehicle and the room, without specialist lifting equipment.
Where access is not possible when we attempt to deliver, alternative arrangements will be considered at your expense. For the purposes of this contract, the term “clear” will include being free from any property which may be damaged when making the delivery.
It is your responsibility to inform us, prior to delivery (see contact details below) of all issues which may affect the delivery and to overcome those issues.
Cancellations can not be accepted on the grounds that the goods will not fit into the location or access to the location is not possible. At our discretion we may offer alternative goods of an equal or higher value, but in the case of higher value goods you will be required to pay the difference in value before delivery.
7. Delivery
"Delivery" means the delivery of the Goods to the delivery address specified on the order and placed in the room of your choice. We will give you an estimated date (except in the case of Special Orders) which will be arranged by our Home Delivery Team (details on page 2). If due to unforeseen circumstances this date cannot be met we will inform you of this before the estimated date and we will re-organise a delivery within 10 working days of the original estimated delivery date.
Our standard delivery rate will be applied to re-deliveries if:

you are not present at the delivery address during the allocated time slot. Allocated time slots are confirmed 24 to 48 hours before the delivery date.

the date and/or time arranged become unsuitable for you (for any reason) and you fail to inform the Home Delivery Team (details on page 2 )at least 24 hours before the allocated time slot; or
-
delivery has been “agreed” and failed for any other substantial reason due to the fault of the Buyer.
Dates and times that we have organised and communicated to you in advance will be taken as “agreed” by you unless you otherwise advise our Home Delivery Team at least 24 hours before the allocated time of delivery.
Goods will be deemed to have been delivered when they are taken from the vehicle at the delivery address specified on the order. You must inspect the Goods at point of delivery and report any shortfall or damages immediately to the driver and ensure that this is noted on the delivery note. You must then contact our Home Delivery Team (contact details on page 2 of the accompanying booklet) who will file a report and arrange for an investigation.
8. After Delivery
For reasons of hygiene once the original packaging has been removed refunds or exchanges can only be considered on items that have been found to be faulty. Any missing or damaged parts must be reported to our Customer Services Department (contact details on page 3) within 21 days of delivery. We ask that you return the goods suitably and sufficiently packed in the original packaging for the normal rigors of transit.
9. Guarantees and warranties
All goods carry a standard guarantee against faulty workmanship. Please refer to the care leaflet contained in the packaging for further details.
10. Credit
If Goods are purchased on credit, they will not be delivered or supplied until credit approval has been received. Goods can only be delivered to the delivery address approved by the finance company. There will be a minimum of 10 days before the goods are dispatched on all credit agreements to enable legal verifications processes to be completed.
11. VAT
All prices quoted exclude VAT.
12. Unforeseen Circumstances
Neither the buyer or seller will be liable in damages nor have the right to terminate this agreement for any delay or default caused by conditions or events beyond our reasonable control. We will make every effort to notify you of any delay or non-delivery, and will take reasonable measures to ensure the goods are re-allocated for delivery once such delay has ceased.
